Public Intoxication Confusion.?

Ok, so I was walking home last night from a party at San Jose, CA when I got arrested for public intoxication. I was held in a detention cell for the night and then released, I tried to ask her if I was in any trouble but she made me leave immediately. When I was released I didn't get any court-date or anything, I only got 2 forms (one of them is a pink detention certificate and the other is a pre booking information sheet)

My question is, did I get charged with anything? or did they let me go scott free? on the prebooking sheet it had 647 (F) which makes me a bit scared that I did get charged with something. But I didnt receive any thing like a citation or something.

-please help me with this confusion thanks..

  1. 647(f) isn't "police" for anything, it's the California Penal Code section that enumerates the crime of public intoxication.

    You mentioned a detention certificate.  Sounds to me like you don't have any charges waiting for you but you need to read the certificate....it almost certainly mentions Penal Code section 849(b)(2) which says you were only detained for your own safety and were released without charges.


  2. 647f is police for "drunk in public." What they do with it is up to the arresting officer and your city's policies. You may have a court date but the time in detention may count as your "punishment."

    Watch the mail or call your local police on their non-emergency number. They may refer you to records for a definite answer.
