Question:

Purchasing Alcohol (Underage!)

So to the main question, is anyone aware of the penalty for buying alcohol underage? I'm 18-years-old myself, and have quite a few friends that work at the 7-11 closest to my house. I have been buying beer there occasionally since they didn't have a problem selling to me.

Last night his manager found out, and said he wanted it to stop. He told me, and I was fine with it. I can't exactly be pissed for something I shouldn't be doing in the first place.

But the police showed up at my house today, and luckily I wasn't home, lol. Anyone know the penalties? I guess I'll just stick around tomorrow and see what they want.

  1. you shouldn't drink underage. It's bad for your health and it affects the people around you

  2. no you wont get in trouble theyre selling it to you if anything deny it so your friends dont lose there jobs

  3. lol nice. lucky for you it isnt illegal to buy alcohol if your younger than 21. it is however illegal to sell or serve alcohol to people under 21 so it is your  friends (or maybe their boss) who is screwed.

  4. The store/you friends will probably be facing the most trouble, but it might be just a fine or something

  5. you wont get in trouble since you did'nt provide false identification. the person and buisness selling it to you will since they new you were under age.

  6. It depends on the state.  It's most likely a misdemeanor for you.  The ones most at risk of being in trouble are the convenience store and the clerks, especially if they knew you were underage and didn't check ID's, etc.

  7. MIght be something totally unrelated. But it is just a fine, $500 I think at least in Ct.

  8. i think its min 3 years in the big house. if they find alcohol in your bloodstream

  9. They cannot prove you drank because alchohol leaves the bloodstream after 24 hours max. I dont think the cops coming were related, what manager would s***w him self by calling the cops.

  10. It depends on what state you live in. Usually for a first time offense its nothing, and a second is just a mista minor like stealing candy or something. There may be a penalty but like someone else said $500 or less.

I really doubt they would come to your house though. Its usually something they have to catch you in the act of. If they are going to do a follow up investigation 9/10 times its with the business that sold it to you. They're breaking the law "worse" than you are.

  11. Odds are that since 34 states don't prohibit consumption by minors, that if you drank the beer they don't care at all.  Possession?  That's resolved by taking it away, but you could claim it's your parent's.  You would obviously need to move any unused beer over to a common location, like the kitchen. It doesn't look like you used a fake ID, but if you did, ditch it.

What they are concerned with is the fact the store sold you beer, which is illegal, a several thousand dollar fine for the store and a revocation of their alcohol license while they retrain employees or fire offending salespersons.

  12. teen drinking is veryy bad.

  13. Tell them you don't recall buying any alcohol at the store. If you admit to it, you're snagged.  Here's the dirt on what you are looking at. It's a freaking misdemeanor in Texas. How can you stand living in that redneck h**l? Your friends are in even more trouble. The manager of the store is an idiot if he bought the cops in.

  14. Honestly, it would depend on the state and town you live in to know the proper punishment.

But the odds are, you can't go to prison for this... if that is what you are asking.

If you do not have any evidence on or in your personal effects, you can not be charged with alcohol possession. If you get rid of it now, it is called tampering with evidence. Another crime... and it can get you in a lot of trouble. So don't do it.

But the odds are, the 7-11 have you on surveillance tape purchasing booze. That would be the evidence they would need for any prosecution.

If you have been giving the alcohol to minors, other than yourself... for example a  Thirteen year old, you could be prosecuted to contributing to the delinquency of a minor. A VERY serious charge.

If the alcohol was used in a crime, lets say a DWI by one of your friends. This could also be a crime that you could be charged with. If it was used as a catalyst in a rape or homicide, you could be charged as an accessory to that crime.

But Honestly... the cops are probably swinging by your house to find out if you have a fake ID. Which is also a crime. They will like to know where you got it, who from, yadda yadda yadda.

The 7-11 store manager and clerk can be fined for selling alcohol to minors. By law, they should be checking ID of anyone who looks to be under 25-30 years of age. The store cold be shut down or just lose the right to sell alcohol  for up to five years depending on the state your in. The company can be liable for any crimes that have been committed while under the influence.

My honest legal advice would be, contact the police officer who came to your house. Cooperate as much as you can with he/she and any D.A that might become involved. You should be okay. Make sure you have legal consul present!

Most states go after the place that sell the alcohol to minors, rather than the minors who drink.

    Good Luck
