Query Reg Work Visa for UAE?

I had applied for job position of Site Administrator in Dubai and I had attended the interview and got selected for the post in Chennai - India this was around 04 May 2008 and they told me that within one month all the visa process will complete. I had given them my Original Passport. ( I think my biggest mistake ) Now i got a job offer in India and i do not want to go UAE

When i went back to the Recruitment Agent to tell that i am no longer interested in the opening he told me that he cannot help me as my passport / visa application in under processing in UAE and asks me to wait for one week i.e 18 June 2008 to get the confirmation. if not by then he will return the Passport. and if the Visa is issued by UAE government then i have to pay money to compensate the company for Visa charges / Cancellation and he is asking 3000 AED.

Please give me your valuable suggestions on the Same.

yes, you have committed a big blunder by giving your passport ( and i beleived you must have given u a lot of money also to get this job, if u did not u are lucky) now u have only two options, pay the agent and get your passport back or go to police and file a complaint against the travel agent. The choice is entirely yours.

In case u havt not paid any money to the agent and recruitment is genuine , then u have another option of contacting your employers in dubai,tell them u cant work in Dubai and request them to help u in getting the passport back. But even in that case if the company has already got the visa approved who is going to compensate them for the expenses they have incurred in getting your visa. u are stuck up, my dear friend, and the easiest possible way is to pay the agent, get your passport back and forget about the whole affair,

By the way in your question, it is not clear that your citizenship / nationality,

Anyhow, If you are a national of UAE, you need the formalities of Visa and work permits...

But if you are an Indian, why you need to wait here, as there is no requirement of Visa or work permit to join Chennai / India, as you need just cancel your current visa stamped on your passport and go on exit from here to India.

If you are a national here, just do as the agency, wait till 18th June and if you get that Visa go ahead, if not, get back the Passport immediately and take the next step.

But, if you get a chanse in a company and interested/commited, it is not good to grab another on the next day.... I mean every day the package structure is changing, so if you chose one, keep stick on it... Otherwise deceide yourself, then give passport for processing...

i think sarkar is correct, from my memory of visas in uae they would need yr passport details but u would be sent the visa paper or have someone meet u in the airport with it, then it its taken to immigration with your passport once ur there for final processing.

i think also the final fees would be payable on completion of the visa not just on applying for it, there are lots of visas applied for for people who dont turn up.  demand yr passport back, tell them u will inform the police or else tell yr passport agency the passport is lost and hopefuly they will issue u a new one and cancel the old one.

The company paid all visa related fees on your behalf and of course wants to be compensated in case you changed your mind or do not fulfill your duties.

The amount of compensation is Dh1,500 to Dh2,000 maximum, and such an amount shall be determined as per the employee's position as well as salary.

Frankly the agent is lying. They never send the passports to UAE.

Your visa application is submitted directly by your sponsoring company in Dubai to the UAE immigration department in Dubai. They donot submit the original passport for the visa application. In case your visa is granted then they will send your agent a copy of the visa (one sheet). You are required to carry the copy of the visa with you (you will need it to buy your air ticket also).

It is true that the sponsoring company spends some money in the visa application process but this should be only a couple of hundred Dirhams.

The sponsoring company may even have provided a deposit/bank guarantee to the immigration department as guarantee that they are responsible for you not running away but this deposit is fully refundable to the company if your visa is not used.

If you have a receipt from the Agent that you have given him your original visa and if you have not signed any papers comiting to bear the cost of visa or any other expenses then I think you can atleast argue with him or threaten to make a police complaint.

ur passport ll be with the travel agent only  just get the passport back from him he has no right to hold your passport  if u have no plans to go to gulf in future no need to cancevl the visa also  if u have plans to go to at a later date its better to cancel the visa .in that case it depends on the sponsoring company
