Question 16 on I-765 form?

Question

I came to the US on a visitor visa in 2000, First time applying for Employment Authorization. I married a US citizen last month and am now doing all the paper work, anyway can't figure out what code to put in for question 16. It's the one about Eligibility Categorys. Hope someone can help me, this is the last thing I need to send everything off, the form is here : http://www.uscis.gov/files/form/I-765instr.pdf

if you are submitting it with the I-485 then it would be C09, as an adjustment applicant.

I guess you are filing form I-485 as well in order to apply for your green card; if so, your eligibility category for the EAD is (c)(9).

7. EAD Applicants Who Have Filed for Adjustment

of Status

A. Adjustment Applicant--(c)(9). File your EAD

application with a copy of the receipt notice or other

evidence that your Form I-485, Application for

Permanent Residence or Adjust Status, is pending.

You may file Form I-765 together with your Form

I-485.
