Question:

Question About CA Unemployment Insurance Code Section 1256 & Unemployment Benefits Hearings?

Has anyone won an appeal of this section? If so, I have a hearing next week, and any info would be helpful.

I was fired from my last job in late May, because a customer said I was unprofessional with her (I wasn't). When I filed for unemployment insurance, I was approved, and I actually got a check for one week.

Later I missed a phone interview with the EDD, because the notification letter arrived late. I tried to reschedule, but I was told I was denied benefits, because of CA Insurance Code Section 1256. I plan to bring documentation, but I'm curious if there is any other helpful info I should know before my hearing. Thanks for your help

  1. When you are denied benefits you should immediately appeal.  I hope you are not just getting around to this.  If you are you will miss all those months of benefits.  Denials are fairly routine and in your case winnable on appeal.
