Question: Conservatives had GWBush and a majority of republicans so...why didn't they repeal Roe V. Wade?

I mean, what was the point in voting all those guys in if they don't get down to business and do all their republican stuff like abortion, guns, prayer in schools and so forth? kinda makes me think the whole shebang is just a smoke screen. Like the whole abortion issue serves the powers that be better as a divisive (and therefore distracting) issue than as an actual final decision. to let it be flat out legal or flat out illegal for a decade or so would end the precious debate.

  3. The courts have to take up a case that would give it an opportunity to overturn it.  

    Did one even come up?

    Its about the courts and appointing judges that would interpret the law a specific way.  

    I dont want liberal judges that legislate from the bench which is one of the big reasons why I am a conservative.

    The only real way it could be done, and it actually is a possibility, is if it works its way thru the courts again.

    Even if it did it wouldnt make abortion illegal.  It would make it a state issue.  There is no reason, actually, why its a federal issue unless it was to actually outlaw it.  The courts really stretched the Constitution when it found some kind of privacy right that really doesnt exist to support it.

    Point out in the Constitution where it says you have a right to an abortion?  Its all intepretations by the courts.  People forget how much power the courts actually have in the US.

  6. Roe V. Wade was a Supreme Court Decision and could not be over-riden by the Cogress nor the President.   They would have to do a constitutional amendment.  But that takes more support to get passed then they have had the power to muster.  Amendments must also be ratified by States.  One more Pro-life President and we could have enough Conservative Judges to over-turn the ruling.  Supreme Court Justices are for life and must by ratfied by the Senate.

Firstly, just because you have a "majority" that doesn't mean you can get anything done.  You need a perfect 60/40 split in the Senate and a 2/3 majority in the House to make sure nothing can stand in your way of passing a law.  As for Roe V Wade, it's all about the Supreme Court, and the only way for the Republicans to get a majority there now is for a few of the Liberal judges to retire/die during a a Republican President's term.

You can't "repeal" Supreme Court decisions; they're not legislation.  What they could have done but (thankfully) didn't is amend the U.S. Constitution to make abortion illegal on a constitutional level.  However, even REPUBLICAN lawmakers have more sense than to tamper with the Constitution without a really, REALLY huge reason, and messing with abortion just doesn't qualify.  Any lawmaker who voted for it would probably lose his job the next time around, and they all know it.  There's a REASON that there have only been twenty-seven amendments to the constitution in the entire 232-year history of the U.S.
