Question about Affidavit of Support?

Ever since my dad got stationed in Iraq, I had to quit my job and become a stay at home "dad" to my siblings and mom. I am the one driving them all to school and back, plus I do the driving as well for my mom who works the afternoon shift. Its been going on like this for almost 3 years, Then when my dad came back from Iraq I decided to go back to the Philippines first to rest. There I met my wife. We got married there, and now i'm back and is going to file to petition her. I got a job again, but my question is what can I do about the affidavit of support? My 3 year hiatus would look bad on the application. How can I explain that? My dad is going to co-support me filing an affidavit of support as well..but will my dad's help alone be enough to save me? He's in the Army.

  1. look.....my hubbies from turkey and we are waiting for his work visa and green card etc blah blah blah.... it all boils down to this......how honest are you???? if your last 3 yrs dont qualify you to be her sponsor then you need to find someone else that can be, because if they found out your lying or trying to pull one over on them you could be looking at a lifetime in the phillipenes buddy.....

  2. No - the letter, well, you'll need a cover letter anyway. I'd think about hiring an attorney, because a decent one can write a compelling cover letter that covers the buzzwords/concerns that immigration officials want to hear.

    Again, a decent attorney can/will set you up with an alternate way of proving support for your K3 visa. What they really want to see is the means of support. Not just you having a job, but enough money to live on. So if your father has money in securities you can use that as collateral.

    There's "the rules" and then there's how things actually get done. Find an attorney that does more than fill in the paperwork for you.

    It can save you. His income or his collateral should be fine. You just need to massage the K3 to work for you and how to file your adjustments. She could be with you in a couple of months. If I remember correctly, the gov't has 90 days to adjudicate your K3.
