Question about IEP..?

My daughter was recently kicked off the school bus. She is kicked off for the rest of the year. Recently she had a field trip and could not attend because of the school bus situation. I stopped what I was doing and took her so she could attend. I heard thru the grapevine that a child with an IEP cannot be kicked off the bus for more than 5-8 days. Does anyone know the answer to this? Being kicked off the bus is not a problem, but during school hours when they have a field trip, that is my problem. She has never been in trouble before,and she is bi-polar. She is only in 5th grade. Help if you can...thanx

  1. If your IEP includes transportation-then appropriate transportation must be provided to get your appropriate education-

    The individual IEP must specify-

    You should amend your IEP-ask for an aide of the bus-

    or if necessary private transportation where your child is the only studnet on teh bus-

    the IEp should also specify transportation accommodations for field trips-

    including a 2nd bus or teh aide to go on the bus


  2. Actually it depends on your district because for most districts transportation is not a requirement it is a privilege. Now with that said and IEP can only be written for a student who's disability is significantly impeding on the students learning (in school only). A student can have a disability, such as bi-polar, but still not qualify if the student is make academic progress. My suggestion would be to ask the school to complete a Functional Based Assessment (FBA) to look at the behaviors that are occurring and from that develop a behavior plan that will be specific to the behaviors that are occurring on the bus. You do know not have to be classified as a special education student to complete the FBA process.

    By the way, there is nothing specific about kicking even a special education student off the school bus for a certain amount of time. The federal code states that a student can only be suspended 10 school days, after that an IEP meeting needs to occur to see if the suspendable offense is a manifestation of the student's disability. If it is found to be, the student can not be suspend because they would then not be receiving FAPE (free and appropriate education). I would suggest talking to your child's psychologist.....good luck!

  4. It is not legal for a student on an IEP to be punished for something that is a manifestation of their disability.

    Does your daughter have an IEP?

    Your child should also not be excluded from going on a fieldtrip because of her disability. If she was not able to ride the bus, and the only way she could attend was for you to drive her, the school actually would need to pay you mileage for transporting since they were not able to provide that service.

    If your daughter's special needs are not known by the school, and are not being accommodated by an IEP or 504 plan, then what I said above does not apply. If this is the case, I suggest you schedule a meeting with your child's teacher, the school psychologist, and the principal to discuss her special needs. She will need to be assessed for services.

My Dear NewWeb friend, this issue is still raw with me and what I went through  with my now 26 yr.old son.  The IEP is a joke; I just picked up the school records of my son because you can get them or June they wil be pitched. They destroy them (Ha) after 5 yrs. from graduation. This treatment is what my son (A Brain) went through for years.  They choose certain children to be in these special classes because they need a certain number to get the grants etc. they need to keep these Emotional Support groups going.  There is no way they should be picking on your child like this and kicking them off of the bus etc. One Time the school called me and said,"Mrs. so and so, your son was found to have taken something off of the teachers desk" I ask what did he take, "A magnifying glass", I went on and continued to describe it,:It has a holding place on the end that hold a small screww driver," Well yes. she answered.  You know why I know? I gave it to him and he put it in his side book bag pocket.  Do you know they still left the pink slip written up and a hands on science  Field Trip was scheduled and I was told because of this incident that he would have to stay with the teacher and could not touch anything.  Do you know what I did, kept him home that day and we had a special day to award him for being so strong through this experience I did not know what else to do to keep his self esteem from being pushed down and destroy my son.  His daddy had left us and to be made to put a child in these classes (even failed him the yr. 6th ) because I demanded him to be in a reg.class.  To give you hope fight for your child.  Before he returned from a school he was trucked for two yrs. out of our tax district because no Em.Support  class in our school for those two yrs., I demanded a Due Process Hearing, The school district heard "Woops a $50,000. bill for this., I had his brother and a moral support from a Parenting Network, and wow, I wrote down what I planned to say about their failed plans.  They had put both my sons in remedial reading which made my boys Hate reading; when I questioned why they did this answer was, "They can read but do not comprehend what they read"  When I ask for a samply of questions on these reading tests It shocked me that the questions were not Exp: What color was Janes' dress? or How many brothers did Sally have? Things covered in the story, for 4th and 5th grades they asked things not even in the story, they were cause and effect questions and that is college stuff.  Thank God the commputer age is here, both my sons have taken up reading and learning even more, My one son in the Em.Support class( he was with all of the trouble makers from all of our surroundlng area, Beat up family, sold drugs ) and all my son needed was to be taught not sat a a table facing the wall with a big poster card with all of his subjects EXP.:8:00Am.-8:30Am.Math pgs. 34-39 etc.

    then he would have to do all his lessons without a teacher and when I found  this out, (I volenterd for his class to help teachers) they never corrected situation. The thing is 9th grade He was put in a regular class room from day one,  (My Demands this time I was in control) his name was in the News Paper with a home room teacher and names of the classmates;  Second semester he made the Honor roll and distinguished honor roll several times until Graduation, won Bradley School of Arts. serveral times and won several other wonderful things.  Only class he needed support was math; they lied on IEP and said he was in 3.3 (code for only knew 3rd grade 3 months math; but I   demanded to have math teacher retest him with commputer tests and he was really 8th grade 11 months; so Honey I am speaking from Years of experience. Call your senaters and speak out for your child. If Yahoo will give you my E-Mail I would love to help you in any way that I can.  My son is writing music via computer and an electrical wiz, you name is and plus he can do house wiring.  We are starting our ouw business.  My other son that stood behind his brother at age 9 is in the U.S.Navy 5th yr.   6. The 5-8 day rule would be based on district or county guidelines.  I would contact the district's special education department to see if it applied to your district or not.   Go from there.  

    These rules are not federally mandated unless her disability causes her not to be able to ride on the bus... first time?  It's not her disability causing the problem.  It may be the start of adolensence causing other problems.  It may be her frustration with her last class of the day.  It may be some student on the bus.  It may be an obnoxious bus driver.  What does your daughter say is the root of the problem?

Unless the IEP states something specifically about the school bus or unless the behavior that got her kicked off is related to her disability, then she can be kicked off of the bus.  Schools cannot suspend a child with an IEP from actual school for more than 10 days without conferencing and providing alternative education options.  If the behavior that got her kicked off of the bus is related to her disability, then you should call a conference and address the issue.  If not to get her back on the bus this year, to address what will happen to prevent the situation from arising in the future...whther that be seating your daughter in the front of the bus, providing an aide, or providing alternative transportation.  If you do not feel that the behavior that got her kicked off the bus is related to her disability, then there really isn't anything else that can or should be done.
