Question about Med Discharge?

My friends husband has been in the Army almost 6 years. he has been wanting to get out for the past 2 years. First he tried claiming depression from deployment and they wouldnt med board him out, well about 6 months ago he started claiming severe back pain. Finally he was discharged 2 weeks ago. In the past week he has purchased a new truck, a dirt race car and a new 4 wheeler, he said he received a "settlement" from the Army. Here is my problem...He is only "injured" when he has appointments or had to go to work... he races his dirt car, carries his kids around on his back, is moving furniture from his old home to his new house,goes 4 wheeling which is very virgous. This upsets because there isnt anything wrong with him, but the true injured soldiers have to fight to get help. Im not a nosey wife, but I want what is right...this guy deserves nothing. Doesnt anyone follow up on people like him or isnt there anything anyone can do to stop this fraud? I have been an Army wife for 15 years so far and have never seen someone so disgraceful in my life as this guy

  1. I don't know if saying anything to the Army is going to help. I mean even if they do check up, I am sure this guy can put on a great front. I'd just let it be. Figure it is better that he is out of the Army then in it. He'll get what is coming to him eventually.

A lot depends on how far you want to take this.  By committing this fraud he deserves to have to pay back his severance pay and any other entitlement he's received from the Army.  But, he's also probably getting a check from the VA...two different entities.  I would encourage photos, or better yet, video tape the person and then take it to the legal counsel of the base you're at.  If they don't do anything then I'd take it to the base commander...or how ever far you have to go to get someone to pay attention to you.  He does not deserve to have received an honorable discharge and receive the benefits that he does knowing he's doing all this!

  3. Take pictures of him doing stuff that he could not do if he really had a back injury.   Such as playing football with his kids,  playing tennis,  hiking with a large back pack,  riding dirt bikes on a very rough track,  etc.  Then take the pictures to the Separations section at your base.  Give them the pictures along with a signed affidavit stating you saw him taking part in these activities and the pictures are of him doing it.   If they can prove fraud on his part in order to get out,  he can lose all pay and privileges,  rank and be sentenced to two years in prison for fraudulent separation.  

    Even better,  if you can get him on video tape!!    

  4. My brother is 60% disabled by the VA and he has to check in with them once a year.  They assess him to see if anything has changed and they deal with the situation accordingly.  Get pictures or video recordings of your husband's friend doing these strenuous activities and report them to the VA.
