Question about a car accident...?

My friend was in a wreck a few days ago and found out that there had been a lapse in her insurance policy. She was unaware of this due to relocation, and she has no idea what to do next. Her car was impounded and she recieved a lien notice for the car. Her insurance company is refusing to do anything for her because of the lapse in insurance. Help me to help her understand this. Since the insurance wont inspect the car and label it as totaled, what does she need to do with the car? Can she sell it to a junk yard, or even have them haul it off for her? Does she need to speak with the other drivers insurance to tell them that her insurance lapsed? What steps should I give her to take?

  1. Is the car totaled?? If she tells the other insurance that she has none then SHE will be liable for repairs to the other car!!! If it can be repaired, that's what I would do. If not then a junk yard might tow it away for a fee deducted from the sale of the car for scrape.. I know they will here where I live.. Just hope like h**l they don't sue..


  2. if it was her fault she is screwed

    if not her fault court action to recover monies from other party must be taken

    but it all depends on

    were police  called

    she found to be at fault  or the other party

    if her fault she is  screwed as ststed earlier

    she can recover her  car sell it  or fix it at her own expense

    and she will owe for the other cars  damage

  3. with a lapse in insurance, she is basically screwed. they dont wanna hear excuses. she needs to inquire about getting the car out of inpound first. then decide where to take it. why was it impounded? is this a hit and run or what? usually they just call a tow truck (her expense and tow it wherever she wants it to go).its only totalled if it no longer can be driven or if the damage is greater than the value of the car. no. she doesnt wanna confess to sh** to anyone but the cops.  seems some info is missing here. sounds like a hit and run or something (to me).

  4. 1. if the accident was her fault and it was totaled and owes money on it then your friend will have to pay off the balance.

    2. if it was the other persons fault then they will give your friend the (ACV) actual cash value of the vehicle at the time of the accident and any difference that is owed your friend will have to pay.

    3. the insurance company is in no way responsible for paying out anything for this since your friend let the policy lapse.

  5. Which ever way it goes she is in trouble. Having no insurance will mean she will be charged by the police, because there are no excuses for having no cover.

    The police will take the vehicle to a compound to remove it from the public highway, and if at the time it is causing an obstruction, they will not wait for her own breakdown recovery to attend.

    Most breakers yards will pick up the vehicle free of charge, but  there will still be charges to pay for the recovery by the police. this is usually about £125.00. This will have to be paid before the release of the vehicle, and all the time the vehicle is in the compound charges for storage could be mounting.
