Question about a dui situation

My dad got a DUI 3 weeks ago and another tonight..he hasnt even been to court for the first one yet!

He also has one from 03. He is in jail right now and was calling me asking for 300 bucks for his bond...I said no. Hes in jail for the night and sees the judge at 9am, she decides if he stays in jail or gets to come home. We live in IL, what is going to happen to him?

  1. Although your question may be technical concerning the law, the more important issue is the one you have already courageously addressed.  Will you be an enabler?  You answered with a clear "No."


  2. Depends on the DUI laws in the State of Illinois, and the Judge.  I want to thank you for being brave enough to not bail your Dad out.  Obviously he has not learned his lesson to be a responsible driver.

  3. First, I would like to applaud you for not bailing your father out.  He apparently has not learned his lesson.

    DUI is now considered a serious offense.  The fact that he received two DUIS within a three week period before going to court for the first will be looked at with much weight.  First, he will most likely never be entitled to hold a drivers license in any state.  Second, he will be looking at jail time.  I am surprised he was even offered bail.

    Your state considers a first and second (typically) DUI as a misdemeanor.  However, a third offense is considered a felony punishable up to 364 days imprisonment, at least a $2,500 fine and loss of license for at least 20 years if not permanently.  With this being said, I hope this will make him learn his lesson.  I would not plan on him being released when he goes before the judge tomorrow.
