Question about a restraining order (order of protection)?

What can be done when a restraining order (order of protection) is not getting to the person whom it is being held against? The police has tried numerous times to deliver the order of protection but each attempt is unsuccessful, not necessarily because the person is not there but more than likely because he is hiding from the police. Are there any laws in the city of New York that protects such a victim, and are there any alternatives for delivering the order of protection?

  1. a restraing order has to be served on him/her in person, there's no other way. it has to be put in their hand.

Each court district has specific guidelines as to who can serve court papers.  Contact the court that issued the order of protection and find out if you can have them served by a private detective.  If so, hire one.  They can spend more time tracking them down than the police can.  Also, carry a copy of the order on you.  Then if you are in a situation where the other person is, and the police are called, then the officer on the scene can serve them.
