Question about bootleg DVDs?

I unwittingly received what I believe is an obvious bootleg DVD set of an HBO series. I told the seller about this, and described it as bootlegged and "unlicensed" by HBO. They tartly replied that they do *not* sell bootleg or pirated DVDs, but also that they "never claimed that the DVDs were licensed by HBO."

My question is, are not HBO show DVDs unlicensed by HBO by default bootlegs?
