I'm in California. My landlord posted a 3 day notice on my door and did not mail a copy to my residence (which is required by law). On top of that, one day after the 3 day notice was posted on my door I got another notice on my door stating that the rent needed to be paid on that day by 3pm or else my file would be sent to their lawyer to start legal proceedings. I was not given the proper 3 days as indicated on the notice, I was actually only given 1 day. So the landlord files an unlawful detainer complaint on me and as evidence in their complaint they submit a copy of a 3 day notice which had been totally changed around because I have the original. The dates were changed and the amount was changed even the address was incorrect. I filed my answer with the court stating that I was not given the proper 3 days to pay and submitted copies of both notices as proof. My question is, will I most likely win my case in court? I don't have a problem paying the rent I just don't think I should have to pay legal fees when they sent my file 2 days shy of the 3 day notice so that should be their fault.

  1. If they failed to comply with the landlord/tenant statutes of the state and it sounds like they did the court will dismiss their claim and you will be allowed to pay the rent.~

  2. Go find another place to live.
