  1. I'm not sure about the state you live in, however in my state you would not owe back payments. Also, your child may still qualify for Medicaid since your husband is not your child's biological father. Unless your new husband legally adopts your child, only your income would count towards your child's Medicaid eligibility.

However I would check with your case manager since Medicaid policy does vary from state to state.

  2. I do not think you will have to pay back any money when you get married. I think your child's medicaid will get cut off if your husband has a source of income that can be verified. If he is a hustler, you do not have anything to worry about. if your husband has a place of employment, after you get married, he will be able to add your child to his medical insurance if his job offers health insurance. If his insurance is good, your child will receive better medical care because the doctors will be able to charge more for services. If this is the case, being off of medicaid is not such a bad thing after all.

  3. They will not ask for any money from him.  Only from the biological father.

  4. Nope, but she maybe pulled off medicaid because they will count his income  as part of your income because you are legally married. Regardless if he is the father or not.  You would have to notify DFCS of the marriage change if not and they find out their was a income change they can ask for money that has been spent on the child since the income change back for the guardians which would you.

  5. I consult on Medicaid and as far as my understanding no back payment will be required.  Once your family gets above the income limit (not until after you are married), you will have to take the kid off Medicaid.
