When you quit a job, if you have accumulated some paid time off, is your employer required to either let you take those days off during your last week or pay you for the amount of time you have?

  1. Only if it is considered vacation time or annual leave time...AND...only if it states in the policies manual that they will pay that time upon leaving the position.  Normally any sick time that is accrued IS not paid.  You need to check the policy manual or ask your HR person what the policy is regarding PTO.


  2. in less then a dozen states the law requires that you be paid accrued vacation at separation, only a couple of them require that if you quit.

    in all the other states that even have a ruling and or law they simply require the employer follow a stated policy.

  3. Not necessarily.

    In nearly all states the law does not mandate PTO.  Paid time off is a gift from your employer and generally it's up to the employer whether or not is paid out at resignation.  Check with your company's written policy first -- if it's not addressed, then check with your state's department of labor website about vacation payout at termination.  If there's nothing at either place, you're likely out of luck.

  4. The only time I have ever been paid for when leaving a job is accumulated vacation time.
