Question about paternity tests and laws surrounding them?

Ok, suppose a woman claims a man is the father of her child. He agrees, and proceeds to provide care for that child over the next 1 1/2 to 2 years. During that time, he pays child support, etc. Now, at the 1 1/2 - 2 years mark, he finds out that this girl had been with another man right before she was with him. He decides to get a paternity test, and finds out that he is NOT the father. What are his rights? Can he get the mother in trouble? Can he get any reimbursment for the child support he paid?

  1. He really has no rights, in some states, they will still make you pay support if you and the woman were married, because you are the only father the child has known.  You won't get any money back that had previously been paid, no she can't get it any trouble.


  2. Yes you can depending on your state. There was a case where this happened, and the "father" was to be reimbursed all support paid by the mother and the actual father then became liable for support.

    Although some states will say that you took responsibility for that child so you are in did the "father" in the legal sense of the word and will continue to be liable for that child.

    This is why its very important that if you even suspect the tiniest bit of doubt to get the paternity test done prior to claiming any child. Its sad that it has come down to this, but some women are scandilous and out to have children and paychecks.  

  3. i dont think you can get any money back because for those 2 yrs the man assumed responsibility. he was named the father and maybe she really thought he was the father so i doubt she'll get in trouble.

  4. he could ruin the mother but he might actually enjoyed that 1 1/2-2yrs. so depends
