Question about renting and broken leases, Landlords and realtors, please help??

Five years ago, i broke a lease when i was living on my own. I still owe that apartment complex about $1200. Since then, my husband and i have been renting only under his name. I assumed no one would approve a lease for us because of my rental history. We have since then, lived in 2 apartment complexes and one rental house with good payment history. The lease is now up in our rental house and we are thinking of moving again, only this time, we'd like for my name to be on the lease too. My question is how likely will we be approved if we are applying as a married couple and his rental history is great. Income is not a problem since we both do pretty well. The money owed is reflected on my credit but im hesitant to pay it because it is over its statute of limitations (TX) and doing so would make the account recent and thus lower my credit score significantly. Any advice would be appreciated!

  2. First off, in TX  5 years is not the statute of limitations...

    What you are "referring to" is that most properties only go back 3 years to determine eligibility. The $$ you owe the property will remain on your credit record a long time.

    Every Property is different in it's "criteria". On my property anyone over the age of 18 has to fill out an application and be put on the lease.  

    Finally, it depends on what the $1200.00 was for. Pure rent is one thing, damages are another. Even though it has been 5 years if it was for any damages, you would have to pay first and last months rent regardless...

    p.s. you should always be on the lease-it protects you. You have very few rights if you are not listed....
