Question about statutory rape?

If two 16 year olds from California travel to Indiana and do it, would it still be illegal?

And no, this has nothing to do with me. I found this website and became curious.

And yes, I've realized this question looks stupid.

i would say yes they could but once back home their parents could get it annulled because they still are "in charge" and it was done with out their consent

Technically it would be legal because they were having s*x in a state where the age of consent was only 16.

I don't think it really matters. People in California probably do it all the time before they are 18. I mean, there are pregnant 14/15 year olds all over, and only a couple of states would be letting kids consent to s*x at that age. Those kids don't get arrested or anything. I doubt that's even statutory rape. It would be in these two hypothetical situations.

1. A 15 year old agrees to have s*x with a 36 year old (the 36 year old is an adult, and the 15 year old is a minor, which is illegal.)

2. In a state where the age of consent was 16, a 15 year old has s*x with a 17 year old. (because one is under the age of consent, and one is over.)

There may be more, but I don't sit around studying this. It's just what I know.

Well, my dad is a paralegal, and he grew up in Indiana.  According to dad, no matter what state you travel in, if it is a crime in the state they are currently in, they can be charged with statuatory rape.  There is an odd exception.  If they both board a plane in a state where the statuatory rape laws do not apply if both persons are over 16, the law stays in efffect until the plane touches ground in a state where the laws define the statuatory rape age level over 16.   While airborne, the laws of the state where the plane left the ground are in effect until the plane touches ground elsewhere.

If it is two 16 year olds then it is not staturory rape.  If one of them is 18 or older then it is.

If you think about it. People only get charged with rape when charges are pressed. Remember it takes two to tango, and if they don't press charges he wont get convicted. It really bugs me when people say that the boy should get charged for rape. Girls are 100% aware of what is going on. Girls aren't as innocent as everyone thinks they are.
