Question about the fiance visa?

I'm currently studying in the US under an F-1 visa. I met my boyfriend out here and we want to get married soon.

Originally we were going to get married and adjust my status but I heard this can take over a year. So our new goal is for me to stay at school over here until the end of the year and then go back to England while we apply for the fiance visa.

Would you say this is a safer route? We just want to make sure everything is done properly.

Also, while I was back in England awaiting the processing, would my fiance be allowed to come and visit me in England if he got time off work to do so?

  1. I assume that your bf is US Citizen?

    Fiance visa is taking about 8 months to 14 months also. And after you come to US K1 visa, you still have to file for AOS which will take about 12 months or so.

    If I were you, I will get married and file I-130, I-485, I-765, I-131 to go with AOS  in US route . In that way you can stay in US with him in US.

  2. Get married while your F-1 visa is still valid. If you want to vist your parents, siblings, etc. apply for an advanced parole form I-131. File all the other required paperwork. Remember that if you leave the country without a advance parole your petition will be considered abandoned so make sure you get everything done on your advance parole. My wife and I met in college xx years ago and did this. Good Luck!

You are better off returning home and applying for your K-1 visa there.  A K-1 visa will allow you to return to the U.S. for a period of 90 days to get married.  If you stay in the U.S. after your schooling is over, you risk all sorts of problems for being out of status.  There is also the problem of your status if for some reason you don't end up getting married - if your not a student with a valid F-1 visa, you are out of status and could be placed in removal proceedings.

    As far as your boyfriend coming to visit, all he needs is a valid passport and he is good to go.  There are no restrictions regarding visits related to a K-1 visa application.
