Question about whether or not Wal Mart has violated my rights?

I have been a Wal Mart Tire Lube Express associate for five months now. I've been working full time the whole time but got a manager to sign a document saying it's okay if I work only the weekends because I'm going to college this fall. Now as the school year is approaching, a new manager says I must work more during the week and calls me a "smart ***" for only wanting to work the weekends. I tell another manager that I wish they'd talk to us more politely, and he says if I have a problem to go talk to Oprah. Is this wrong? Am I really a smart *** for wanting to work only weekends? I'm in college and my major is electrical engineering (which requires a great amount of time). Also is it ethical to tell me if I have a problem, to go to Oprah? I honestly feel like getting a lawyer.

  1. If you have a contract that states that you are allowed to only work weekends then there is a reason to get an attorney because your contract has been breached. Thats it legally. its just those type of people you have to deal with


  2. None of it is very nice, but if these things were said at my work it would probably be the nicest things anybody said all day.

    I feel bad for you because you need to work while you go to school, etc., etc., but I wouldn't waste my time getting a lawyer.

    This is their way of telling you they don't give a d**n about you or your problems. This is because they don't. You're life will be full of people who don't. Suck it up and chalk it up to work experience.

    Is there anything you can do about those couple things he said? Probably not, the case would end up being a ton of heresay and get dismissed. Besides, at this point.. what is being said is still very petty. I think most people on here can think of a manager they had that they didn't get along with or who said mean things.

    With a job like wal-mart.. it is their choice as to whether or not just let you work weekends.

    Your best bet is to look for a new job.

  4. Save your money on that lawyer it will be a he said you said unless you have someone that overheard your conversation and they will back you up,but I wouldn't hold my breath.personally I would go find a job that they will want a weekend guy with your skills.

  6. You should get a lawyer and sue him.  I heard about a guy who told someone to "Talk to Dr. Phil" and was throw in jail for 12 years.  Your case is pretty similar.  Its also pretty solid.  It wouldn't be a waste of time or money to persue it.  

  7. You need to report this manager. Did any other associate hear him cuss you.  I would get all my facts written down and report this harassment.  Management is not allowed to berate their employees.  And start looking for you a job somewhere else....hurry.  You do not need Walmart if the atmosphere is less than friendly.  Pray for this manager.  Good Luck.

  8. You are wasting your money if you hire a lawyer. No Wal-Mart did not violate your rights. Quit your job before wasting your money on lawyers. The Manager that signed that document is no longer there so the new Manager has control of how things run. You are out of luck dude! Come on don't let this get huge; just move on and find another job that is flexible to your school schedule!  

  9. ok well way to many people think that the answer to everything is to go and get a lawyer and take people to court.  that is not the answer!  how would you ever prove it anyway?  also..its not like you have this awesome job that you worked so hard to get..its walmart..its about to be part time..and they pay you minimum wage...you can find that anywhere. anyways..it is perfectly fine for you to only want to work weekends when you are going to school.  no the manager should not say those type of comments to you...that is completely wrong. my advise to you is to either deal with it and let is go away on its own and only work weekends or you can always quit and find a new job.  you would just be working weekends anyways and its not hard to find somewhere else to make a little cash. if you are really pissed at this guy you could always write a letter to the head person at the store or the area manager and tell them about the way that there managers talk.  they might get yelled at for it and they might not. good luck..and just please don't think that every time someone says something rude to you or something happens that you don't like that you need a lawyer so you can go and sue them or whatever.

  11. The courts would be overwhelmed if there was a legitimate cause of action everytime a manager or supervisor acted like an impolite jerk.

    At this point, I'd suggest looking for a new job with Jiffy Lube, or wherever.  This guy is foreshadowing things to come.
