Just a quick question concerning driving rules. Currently reside in Pennsylvania. When would a moving car not have the right of way? I mean driving on a two lane road following the speed limit and of course a signs and/or signals. Reason - lady (in car of course) runs into me and damages my car from door to back rear well. She says I was in her path while she attempted to move left from a parked position. My front is untouched so I was actually passed her from my view just really dented my passenger door a rear wheel well.

  1. Where I live (Alberta Canada), any driver entering a roadway from a parking lot, driveway or back lane must STOP before entering that roadway. When pulling out of any parking spot, a driver must yield to the driver already on the roadway....

another driver can say whatever they want, and they might even believe they are right, BUT that's what the Rules of the Road are for...........a driver's rights in the courtroom.....

I don't think you have any problem....

  2. she drove into you it is her fault. you need to realize the person will say anything to put the blame on you. call the police  then let your ins. carrier handle it.

  3. i hope the police was called and they made out a police report. just inform your insurance company and let them handle it.

  4. sounds to me like she is at fault.  if you were already on the road, and she was parked, she should have stopped for you.  Also, The fact that the damage is in the rear of your car proves that she hit you.

  5. This would be her fault plain and simple.........
