  1. Contact an attorney!

Insurance has to pay fair market value, not blue book. Look for cars just like yours for sale and see how much they are selling for. You have the option of shops to have your car repaired at, the insurance company can not make you take it to their choice!

  2. Get a lawyer. You could also inform his insurance company that you're starting  develop some neck and back problems, and it's going to cost them.

  3. take money ...you never win fighting an insurance co...never...

  4. First did u notify your insurance?

well first is the condition on how badly the car has been damaged first take the car to an auto shop and see if it can be fixed or not

and blue book may be different because they only estimated a price for a fixed car not a broken one(because they have to fix it)

best it to check around stores or jusk ask your insurance they should know what to do

you can keep your car but they wont pay your that 3800

you can fix it and they will have to pay no matter what

  5. Contact you own insurance company and file a claim through them.  They will often treat you better than  the other company.  spell check

  6. Ok first of the insuarance companies are required to allow  you to take it to your own shop second they will lie to you telling you they wont' cover it. but it is also state by state, so as at least one other person has told you contact a lawer. they will help you out. were you injured? also they will only give the low Blue book value.
