Question on assault charge?

A friend of mine is a manager at a restaurant and caught one of his employees stealing so the employee was fired. The next day 2 cops show up at his work and tell him that he has to go see the magistrate that night after he closes. About an hour before the restaurant closes 2 cops show up again and put him in handcuffs and take him down to the magistrate. He told me he wasn't told anything just handcuffed and put in the car. When he got to the magistrate he received a paper showing his court date and was told to leave. He was pretty sure it was the guy that was fired and then when he read his paper it said that it was and that my friend punched him in the face and pulled his head down between his legs to imitate oral s*x. Well the date it says it happened that guy didn't work so what were the cops problems or do they go arrest anyone that is accused of something like this. Is there anything that he can do legally against the cops and/or this guy?

For the type of accusation made, your friend will be considered guilty until proven innocent.  It is a difficult charge to beat, from what I understand.  Tell him to make sure he has every piece of evidence with him when it goes to trial.

You know that in this country you're supposed to be innocent until proven guilty.  However, it's the complete opposite.  You are guilty until proven innocent.  And that sucks.  But there is nothing anybody can do about it.  You can go get a warrant on anybody for anything and not have to have any proof and that person will be arrested.  Then they have to go to jail where they wait on a court date and then hope that the bond isn't too high.  Then they have to go to court and this stuff will all show up on their criminal background check when they go to apply for a job.  So there is not really anything that can be done, if you want my honest opinion.

the cops don't decide who gets arrested --- the former employee probably went to the courthouse and swore out a warrant for his arrest.   tell your manager to get a lawyer- then after you win the case, sue the guy for lying
