Questions about child support?

I keep hearing that the judge goes off of what the father makes..What if the father has no job? does that mean i get no support?

  1. Not in my state.  (Virginia)

    If the father does not have a job, the judge sets an amount that's fair to the statewide earnings for minimum wage.


  2. in my state if the father has no job they put an order for him to find a job and until he does they go by minimum wage.

Yes, they go off of what he earns.  And if he has no job, he's not earning anything.  However, when the person that is supposed to pay child support is unemployed, they will figure his income to be at least minimum wage.  So long as he is not legally disabled, he is capeable of at least getting a min. wage job.  So they will use those numbers and "pretend" that's what he's earning.  Then since he has no job to automatically deduct the payments from, he will be responsible for making the payments himself.  And if he does not, it will rack up as back support, that will have to be paid eventually.  If he lets the back balance go to far, they will take his DL, tax refunds (when he starts filing again), freeze & sieze his bank accounts, put liens on any property in his name (car, house, etc.), put it on his credit report, & jail.  So him being unemployed is not going to get him out of anything.

  5. it really depends on your state because in GA/AZ it is by both parents which sucks because if the guy is lazy they dont have to pay much if anything!
