What is Mut'ah?

Mut'ah is a type of marriage, used in the same way as a permanent marriage (Nikah) in order to make a man and woman physically halaal to each other. A Mut'ah is a temporary marriage that ends at a fixed period. Imam of Ahl as-Sunnah Waheed ad-Deen az-Zaman, in his footnotes of Sunan ibn Majah, defined Mut'ah as follows:

Mut'ah is a type of Nikah until an agreed time. It can be for a day, two days, a month, one year, three years etc.

Waheed ad-Deen az-Zaman. Sunan Ibn Majah. Volume 2, p. 76

Imam Nawawi in his commentary of Sahih Muslim, relied on the definition of Mut'ah advanced by Imam of Ahle Sunnah Qadi Iyad as follows:

وَاتَّفَقَ الْعُلَمَاء عَلَى أَنَّ هَذِهِ الْمُتْعَة كَانَتْ نِكَاحًا إِلَى أَجَل لَا مِيرَاث فِيهَا , وَفِرَاقهَا يَحْصُل بِانْقِضَاءِ الْأَجَل مِنْ غَيْر طَلَاق

"Ulema agree that this Mut'ah is a Nikah in which the husband and wife do not inherit from eachother and separation would take place on the completion of the Specified time without Talaq".

The Sunni scholar Allamah 'Abd Ar-Rahman al-Jazeri in his Al-fiqh 'Ala Al-Madhahib al-Arba' said:

أما حقيقة نكاح المتعة، فهو أن يقيد عقد الزواج بوقت معين، كأن يقول لها: زوجيني نفسك شهراً. أو تزوجتك مدة سنة. أو نحو ذلك، سواء كان صادراً أمام شهود وبمباشرة ولي، أولا

The reality of Nikah Mut'ah is that, in the marriage recital performed with a woman, words are added which stipulate that the marriage is for a fixed time. For example a man shall say 'she shall remain as my wife for a month, or I shall have Nikah Mut'ah with you for a year." The parties themselves act as witnesses. It can occur in the presence of a Wali or witnesses, or without them.

The Sunni and s**+'a have no disagreement as to its original permissibility, though in recent years a number of Wahabis have claimed that Mut'ah was never permissible at all (contradicting the mainstream Sunni attitude). Sunnis believe that, in spite of its original permissibility in Islamic law, it was later abrogated, whereas the s**+'a reject this view. According to the teachings of the Imams (as) who came after the Prophet (s), Mut'ah was never abrogated and continues to be halaal until the Day of Judgement. The Prophet (s) neither deemed it haram, nor put an end to it, nor did Allah (swt) send a verse abrogating it. Rather, Mut'ah was declared impermissible by 'Umar ibn al-Khattab, in direct contradiction to the command of Allah (swt) and His Prophet (s).

How is Mut'ah Contracted?

The contracting of Mut'ah is just like that of Nikah, both require specific words to make the contract halaal - both types of marriage have Dower. The difference between Mut'ah and standard Nikah is that there is no specified time scale, whilst a time scale is necessary with Mut'ah. Mut'ah has many Shari'ah rules / regulations if one wishes to learn further they should consult s**+'a books of fiqh.

Which type of women can you contract Mut'ah with?

Similar rules that apply for Nikah apply for Mut'ah - if certain types of women are haram for a man to contract Nikah then the same rule applies with Mut'ah. A man cannot contract Mut'ah with a married women, as is the case with a normal Other rules along this line are stipulated in our books of fiqh, which will be discussed in the appendix.

Iddah (Waiting Period) in Mut'ah

Iddah is obligatory upon women in Mut'ah, just like in Nikah i.e.

A woman cannot enter into Mut'ah marriage, till the time she has become pure by observing the 'iddah (waiting period) from her earlier husband.

And after expiration of Mut'ah marriage, again she has to observe 'iddah, before getting married (either Nikah or Mut'ah) to any other person.

What is the position of children born from Mut'ah?

There is no difference between the children of Nikah or Mut'ah. Both are considered legitimate under the Shari'ah - they inherit from their parents, and all Islamic laws apply with regards to paternity.

Do all principles that apply on women in Nikah also apply in Mut'ah?

Yes the same principle/rights apply - two people cannot contract Mut'ah with the same woman at one given time, and so forth. We will discuss this further in our appendix.

Now The Question is ,why was it prohibited and who prohibited it on whose orders,,,when Alhamdolillahe Glorious Quran says

MUHAMMAD FORBIDDEN FROM UTTERING ANY RELIGIOUS INSTRUCTIONS OTHER THAN QURAN

"This (Quran) is the utterance of an honorable messenger. It is not the utterance of a poet; rarely do you believe. Nor is it the utterance of a soothsayer; rarely do you take heed. A revelation from the Lord of the universe. HAD HE EVER UTTERED ANY OTHER RELIGIOUS UTTERANCES (attributed to us), we would have punished him severely, then we would have stopped the revelation to him (fired him). None of you could have protected him against us." (69:4047)

MUHAMMAD ORDERED NEVER TO DEVIATE FROM QURAN. DEVIATION MEANT SEVERE PUNISHMENT

"They almost diverted you (O Muhammad) from our revelations to you; they wanted you to fabricate something else to consider you a friend. If it were not that we strengthened you, you almost leaned towards them a little bit. Had you done it, we would have doubled the punishment for you in this life, and after death; no one could have protected you against us." (17:7375)

In setting the example for us, the Prophet was ordered to adhere strictly to God's revelations to him, specifically identified in 5:48-50

now another question,where is Mutah decreed by Allah Allmighty In Glorious Quran,and where is it prohibited by Allah Allmighty in Glorious Quran.

if Mutah was never Decreed by Allah Allmighty in Glorious Quran then why Prophet Muhammed MADE IT LEGAL on his own initiative,NOT Authorized by Allah Allmighty. and if it was Legal by Allah Allmighty then why Prophet Muhammed made it Illegal on his own initiative..

I completely agree with first answerer when he said that a shaytwaan WILL ALWAYS back another shaytwaan. As a matter of fact, instead of backing those believe in Muhammad as the FINAL messenger, they prefer to back the infidels/kuffar!!! Do they not fear Allah????!!!!

'Urwa b. Zabair reported that 'Abdullah b. Zubair (Allah be pleased with him) stood up (and delivered an address) in Mecca saying: Allah has made blind the hearts of some people as He has deprived them of eyesight that they give religious verdict in favor of temporary marriage, while he was alluding to a person (Ibn 'Abbas). Ibn Abbas called him and said: You are an uncouth person, devoid of sense. By my life, Mut'a was practiced during the lifetime of the leader of the pious (he meant Allah's Messenger, may peace be upon him), and Ibn Zubair said to him: just do it yourselves, and by Allah, if you do that I will stone you with your stones.

If you have time then I recommend you don't waste it asking the Rawaafidh who will just use Taqiyyah. Go read their own books, they cant hide what's in their books so they just run from it.

I posted in a previous question how in the Raafidhee book al Wasaa'il the author narrates from some Shee'ee Imaams that they consider Mut'ah with Mushrikeen permissible and Mut'ah with married women as permissible.

Shall I repost them?

I really dont understand what makes them think that they make an effect by their attempts to attack sunnis. Just because we don't consider them much to actually put effort into refuting them they go keyboard happy with their questions.

On a side note, why is it that whenever you ask a question to the Rawaafidh about their 'Aqeedah al Faasidah, they always run to say "it's in your books", no... not in the way you believe it (pick and choosing). Bring YOUR shee'ee books.

For example this guy who mentioned what an-Nawawee said, why didn't you bring the entirety of what he said? Why did you bring a single line when an-Nawawee mentioned the Ijmaa' of Tahreem of Mut'a in his Sharh of Saheeh Muslim? Why lie and deceive like this? I don't understand... is your position that weak that you think you can fool people? You don't think that we can check and verify your claims?

In the Raafidhee book, al-Wasaa'il 14/462 it's mentioned that Mut'ah to a Majoosee is permissible:

فعن محمد بن سنان عن الرضا قال : سألته عن نكاح اليهودية والنصرانية ، فقال : لا بأس ، فقلت : فمجوسية ؟ فقال : لا بأس به يعني متعةً

On the next page it mentions:

عن ابن سنان عن منصور الصيقل عن أبي عبد الله قال : لا بأس بالرجل أن يتمتع بالمجوسية

On page 457 it mentions that Mut'ah to a Married woman is permissible:

عن ميسر قال : قلت لأبي عبد الله (ع) ألقى المرأة بالفلاة التي ليست فيها أحد فأقول لها : لك زوج قتقول : لا فأتزوجها ؟ قال : نعم هي المصدقة على نفسها

On page 454 al 'Aamilee said:

عن زرارة عن أبي جعفر : سئل عن رجل أعجبته امرأة فسأل عنها فإذا الثناء عليها يثني في الفجور فقال : لا بأس بأن يتزوجها ! ويحصنها

There's plenty more... their books are filled with these narrations.

"Abu Horse"... is that meant to be an insult? If it was, that's really a horrible attempt at trying to "insult" me.

"Fabricated hadeeths"... I dont doubt that the Shee'ee narrations are fabrications, but they're the cornerstone of your 'Aqeedah. Want more? I have enough access to the Raafidhee books here to post from your books and "Imaams".
