Re entry in US after 2 months on B1 B2?

Me and my wife were in US since Sept07-July08.I was on a training prog. for 6months and we had to file for an extension for sightseeing.We had left before the date of extension that we had sought.We never recieved any information from USCIS about our Extension.Now we are travelling to Canada next month and want to visit US in Sept. that will be after 2months of our departure.Will we have any problem at the airport and what should we do.We plan to stay for 1 month only as i want to explore some business oportunity.Is there any chance that we will be denied entry?

  1. Every time an alien applies for admission, there's a chance he will be denied entry. If you want to avoid that possibility, you would be wise to have the Notice of Action form with you showing that you properly applied for an extension. If you didn't receive an acknowledgment from CIS, perhaps you could use a canceled check or a receipt to show that you applied for an extension.

    You will be in good shape if you turned in your I-94's when you left. That will show when you departed, and the computer records and/or your evidence will show when you applied for an extension.

    If that application was approved after you left, you will be in good shape. If it was denied after you left, that won't help, but it'll depend on the reason for the denial.

    Your chances of being admitted without any trouble are good, but, like I said, there's always a chance someone will be found inadmissible.
