Can I re-open a medical claim after 10 years; if I had medical proof of injuries that were resulting from an auto accident in a no fault case?

  1. it isnt up to the state, it is up to the policy. most have a 6 months to a year to do a review or 're-open' a claim after it was settled. that is why the lawyers get on tv and say dont sign any paperwork until you talk to us first.

    Each state has a statute of limitations. After that, the claim is gone forever.

    The statute of limitations in most states is 2-3 years. Although Florida is 4.  No state has a statute any where near 10 years.

    Some coverages (like Medical Payments and PIP) are contract coverages and will be bound by the statute of limitations for contract law - in my state that is 7 years. Most likely this statute has run as well.

    The good news ...is if you have a car wreck and injure someone, they can't come out of the woodwork 10 years later and try to sue you.

    Not to mention--- you're not going to get very far with a claim that a car wreck 10 years ago caused the problems you are having now.

  3. i seriously doubt it. each state has a statute of limitations. 10 years is a bit long to try to re-open a medical claim. anything could have happened in 10 years.
