Receiving unemployment funds?

a person that is terminated for discipinary reasons will not be able to receive funds for unemployment, but what happens when the person is reinstated after beingout of work for 12 months, and reinstatement says that they job made a mistake and that person is allowed to come back to work, is he ellegible then to apply for unemployment, sicne his reinstatement only gets him to retirement. so after applying for retirement, can he get unemployment? espeicall for the 12 months that he was out of work.

  1. Anyone is ALLOWED to apply.  But with 12 months out of owrk, he's probably not going to qualify for new benefits.

    However, if they had gotten another job during that time, then it's possible, as it doesn't matter WHICH jobs you were working; they all count towards your benefit eligibility.


  2. I dont know what state that you live in but if this were the case then each state does work differently.  However here in Indiana I have been through this.  There is always something going wrong with the unemployment system.  

    They should have a central office that you can call and a claims adjustment center or here we call it an ajudication office.

    Tell them your story and don't give up.  If you were entitled to the funds they the company must pay.  Especially if they admitted to making a mistake.  If you can get this in writing then this will really help you.  

    Or at worse talk to an attorney.  They possible help you in obtaining the funds for lost wages.  If you call your local Equal Employment Opportunity Commission They will usually help you or refer you to someone who can and advise you what you can do. They will also inform you of your rights.

    Also if this does not work then usually the Department of Labor will.

  3. Get a lawyer quick you need one for several reasons don't wait.
