Question:

Recently my mother passed away. My father had a small group life insurance policy through his job.?

He filed a claim and was denied because my mother was on disability. I'm curious , if anyone knows, if they can deny the claim even though her death was not caused by her disability.

  1. If she was accepted on the group life ins. and did not commit suicide they HAVE to pay if your dad paid the premiums. So very sorry for your loss....Call an attorney if needed!


  2. I am truly sorry to hear about your mother.  Unfortunately this is not a "yes/no" question, but depends on the policy and any restrictions on it.  My guess is that there is some clause which denies benefits for them to state that, but have a lawyer take a look at the policy to make sure.

  3. have dad contact the human resource dept at work and ask them to explain why it was denied and if there is anything that can be done to override it

  5. Yes, they can.  If he didn't disclose her disability on the application, or the annual renewal form, even though she didn't die of it, that lie will void the coverage.

I doubt if she was covered.  A group policy through a job covers him.  (the group is the company)  He may have applied for spousal coverage as an add-on and it sounds like that is what was denied because of her disability.  If she was included on the policy while she had this disability (unless he lied or omitted that information on the application), then they have to pay out.
