Reckless Driver is Jerking me Around. Please help!

My baby (mustang) was hit while parked. I talked to the guy who hit my parked car and he said that he has insurance. He was ticketed for reckless driving and on the police report, there was insurance information. I called the insurance company on the police report and was told that he was not insured with them. Since the driver's address was on the police report, I went to his house to try to make things right. (I do have insurance but I wanted to try to submit through his). He was very nice and offered ANOTHER insurance company's information. I called them and the same has occured. He does noy have insurance with them. So, I am forced put it through my insurance and pay my $500 deductible. My question is..how can I recoup my cost? Will my insurance reimburse me or do I have to take the driver to small claims court?

  1. You pay a premium for insurance each month, year after year...why not use it.  If you have the correct coverage they can waive your deductible, start your repairs and do/finish the leg work that you've been doing on your own.

    Don't let this idiot jerk you around anymore, let him deal with a large company that he'll have a difficult time getting around.  He'll also be reported to the DMV, they may suspend his license or give him a hefty fine.


  2. Sounds like he's just hoping you give up since he has a past reckless driving charge, and adding this to his insurance will increase his already increased rates (and im sure he pays a nice premium with that charge on his record already).

    Anyways you should talk to your local police department, or the officer who took the police report, and let him/her know your situation. Let them know false insurance information was given to you the first time, and upon asking another time, it was given to you once again. Hopefully they can go to his home and get his real insurance information out of him, or if he has none, then maybe he'll receive a ticket for that. If you get his real insurance info, just go through his insurance company and make them pay it all.

    If he doesn't have insurance though, or you can't get his real insurance out of him, let your insurance company know what's up, and give them the guys information and request that they go after him for the $500 deductible, most insurance companies would be glad to do this for you. They have some of the best lawyers out there, getting that $500 out of that guy would be easy for your insurance company.  

  3. .  You will have to pay your insurance company the  $500 (deductible).   Your insurance company will then pay for your repairs.  The  insurance company will then go after the other guy and when/if they collect from him, they will return your $500.  Never, never ever try to settle on your own.  Always, Always, call the police and always, always notify your insurance company.....ALWAYS !

  4. Put it through your insurance, and your insurance company may take him to court for you. That's what you pay them for. To take care of this stuff for you.

    Don't neglect to call the police back and explain the situation and file a complaint. In some states, driving while uninsured is a crime.

  5. Pass everything to your insurance company and let them deal with the jerk. That's why you pay them.  AND contact the police officer listed on the ticket and tell her/him that this person doesn't have valid insurance. That's another ticket for the bum, plus if Johnny Law shows up at his door, maybe the bum will give up his REAL insurance company.

  6. id take that son of a ***** to court and sue him for a 1000 , 500 for the deductibe, and 500 cuz u had to miss work that day so you didnt earn any money  

  7. take the report to the police station.  let them know that they were given false information.

    call your insurance company and log a claim.

    you can take him to small claims for the deductible and such
