  1. One of the biggest challenges faced by law enforcement in QLD, Australia, is that we are no longer being challenged on our evidence. This due primarily because of the fact that we record everything.

    Most legal challenges these days lie in the technicalities of law and legal interpretation.

    Without doubt a recording can be accepted as evidence in a court. I submit CD copies of all conversations I have with defendants which have been recorded on a digital recorder.

    If the defense has any doubts as to the authenticity of a recording it is incumbent upon them to provide expert evidence as why the recording should not be admissible.

  3. Sometimes. They have to be authenticated, meaning that someone can testify as to who is speaking on the tape, they have to be relevant to the case, they cannot be hearsay and they must be legally obtained.
