Question:

Recruiter told me wrong when I enlisted and now I am being admin seped ?

When I enlisted into the Navy Reserve i told my Navy recruiter everything about my juvenile offense and he told me that I would need to get a waiver if I wanted to enlist. I told him okay no problem. then a few weeks later he told me that I did not need a waiver any more cause the records would not show up on a police report because they are sealed. So he told me it was ok to sign the non disclosure form stating i had nothing. So I did! (Stupid me) now he give me the security clearance form to fill out and I asked him if I need to disclose on this form he said yes put everything... so I did no problem cause I was not trying to hide anything as I all ready told him. Now 6 years later I am getting activated for duty I was called and they told me I was being admin sep'd for fraudulent enlistment.. Wait an minute I told my recruiter everything and now I am getting this... They did how ever tell me since I was not trying to hide anything that I could get a waiver. What are my chances at getting a waiver?

  3. I would like to think that it would happen automatically due to the amount of time in the Navy you have already spent, and due to the fact that you did NOT delibertly try to hide this.

    The Navy in it's ignorance may think differently. I strongly suggest that you get legal aid from JAG. You might need it.
