Question:

Redundancy Entitlement

Employed by same company for 13 years. UK based company but I'm employed by USA region. Company in some financial strife (not hitting profit numbers) and need to reduce headcount.

For reasons that I care not to go into (nothing bad or misconduct or anything, basically out of favor with the executive team) I am on the chopping block.

One very senior person in the company is fighting to keep me in a job and may have an opportunity while the rest of management team are against it.

The opportunity has not been made official and I have not accepted. I was told that if this new opp doesn't happen then I need to start looking for a job.

I have a US employment contract (and non compete) with this company. It states that I am entitled to 3 months notice unless there is gross misconduct (which there's not).

If offered this new job, do I have a way to decline (directly or subtly in a round-about way) and take the 3 months instead?
