Registered will challanged in court, evidances produced, matter pending 10 yrs. What to do? How to expedite?

Hindu family,cross examination of "will beneficiary" is pending from 2003. However matter get delayed due to death of other legal heirs and submissions on additional heirs. How to go? Probate appropriate at this stage? Result of lower civil court may be in our favour after couple of years but others may take up matter in higher courts for years, any other legal course for quick and final judgement?

  1. No other legal course but out of court settlement with the challengers of the 'Will' even though this seems to be most uncalled & against the moral principles you follow. The court proceedings takes its own time even if you try getting an order from the High Court for expediting the probation proceedings in the Subordinate court as the loser of the case in subordinate court's order definitely goes to appeal against the order to higher courts till the issue finally get sorted out which may take another 10 years or so. Whatever your Advocates has till date advised you is nothing but making clear fool of all of you as these guys were never interested in the settlement of this minor issue of probation of registered Will which has taken 10years & more to follow. Sorry my dear friend this is irony of life for litigants who jump in for court litigation without thinking the ultimate consequences.
