Question:

35 hours part time??

for the last two weeks straight, i have worked 35 hours, 6 days a week. i am still considered part time. i'd really either like more than one day a week off, or to be put as full time. is all of this within the laws that govern our country/state? (i live in ohio.)

Ohio doesn't have any special State laws pertaining to hours for consideration of FT employment.  Usually that is left to the employer, most employers consider anything under 40 hours a week PT, but do however have PT status employment with benefits if you work so many hours a week, for example 24 hours a week.   However in your case your employer is in their legal right to work you 35 hours a week divided up how they see fit.  This is unfortunate for you, and a lot of other people in this situation.  All you can do is ask your employer to have two full days off, but if that is impossible, you might want to look for other employment.  If you do look for employment elsewhere make sure you understanding their scheduling of hours you would work, you can also look for employment that has PT hours but offer benefits - in which case you would accrue vacation time, as well as health insurance benefits etc.

  2. as far as the federal law is concerned there is no such thing as full-time or part-time. these are just terms used by employers generally to determine eligibility for benefits. the employer can set any restriction or qualifications to be considered full-time or part-time.

    the 40 hours per week is only used (by law) to determine when an employer must pay overtime. an employer has the right to schedule as much or as little as they deem needed to run their business as long as they pay you accordingly.

    as far as the laws in Ohio:

    there is no definition of full-time

    overtime is based on over 40 hours in a work-week

    Ohio does not mandate a day off in seven or limit the number of hours you can be scheduled to work

    "if this is all within the law, what is the difference between part time, and full time?"

    whatever the employers POLICY says the difference is.
