Accident in our driveway?

We have a long and winding driveway that slopes down- it can be little tricky in the winter. There was no snow on our driveway but there was a small pile of frozen snow leftover from the last storm. A friend hit it with his new car which is small and now his car is messed up . He hit it head on hard. Are we at fault? He was the only one in the driveway at the time and we were in the house when it happened.

  1. He was driving. He should have been in complete control of his vehicle at all times! He hit a stationary object. He damaged his car due to his negligence! He is the only one responsible!

    You did nothing wrong, so you have no liability! There is no requirement that you clear all snow from your private driveway. He should not have been going so fast that he could not stop!

The police don't care what happens on private property, and will not file a police report on this incident.  Your friend was in control of his vehicle and is completely at fault for the damage to his car, but if you want to help him out, you may see if this damage could be covered under your homeowners liability insurance.

  3. take pictures of your driveway and tell your friend to call the police and report it as a accident then call his insurance company..if he doesn`t have insurance do a police report anyway... when you drive  ,you are responsible for control of the car at all times ..

  4. This is another case of not being in control of your vehicle and this is his problem.

  5. If he was driving then it is his responsibility, no body elses.
