Adopting...?

am now a 19 year old F1 visa student in the US (GA state) and my uncle and aunt are going to adopt me. Will that be accepted according to the US law? I mean, I am already older than 18, will I be adopted anymore? Btw ,how long does it take to finish the adopting? Will I have all the rights like an American have?

Any answers will be appreciated.

Thank you very much.

P.S I need as many answers as possible.

  1. Actually, there must be a provision for adopting an adult.  A couple years ago in San Francisco, California, it came to light that two attorneys (Noel & Knoller) adopted an adult prison inmate (Schnieder). The attorneys were in their 50's & the inmate in his 40's.  

    This had to do with the case of a dog attack (by a 120 lb presa canario) on a woman (Diane Whipple) in a SF apartment building. Sadly the woman died from the attack.  

    Anyway...check out the laws in your state.  Find a good family law or adoption attorney. Be sure to ask about the immigration issue.

    Usually a child adopted by US citizens, you become a US citizen when the adoption is final.

  2. Because you are an adult, I am fairly sure that you will not be able to use your aunt and uncle to gain the benefits of US citizenship.

    That said, you may be able to get US citizenship when you get your degree if it is in a field in which there are shortages of US citizens.  I have been asked (proudly) to provide letters to the US immigration office for engineering students from outside of the US who fulfill the shortage of engineers in the US (most students in the US are too lazy to endure the rigors of engineering degrees).

    Not knowing your field of study, I hope that you are in a field where the US cannot meet the demand.  If so, this is great leverage for you.

This is the second time I've seen your question, but I'll answer it again.  Some states do allow adult adoptions.  You'll need to ask a lawyer in GA.  However, adoption will NOT grant you citizenship automatically.  You must still apply for citizenship and become "naturalized" which can be a long process.

  4. I haven't the slightest clue about there but in Canada you CAN adopt an adult. Talk to a lawyer.

  5. i dont think you can be adopted when you are 18 or older cuz soon you would or should be moving out of their house and going to college and stuff.  If you think about it, it would be adopting an adult...and thats kinda pointless i think. but i dont know this kind of stuff

  6. Here is the Georgia State Statute regarding the adoption of an adult by another adult.  It's pretty straightforward.

    Summary: Adults may be adopted with consent of the person to be adopted.

    Most Relevant Georgia Statute:

    § 19-8-21

    (a) Adult persons may be adopted on giving written consent to the adoption. In such cases, adoption shall be by a petition duly verified and filed, together with two conformed copies, in the superior court in the county in which either any petitioner or the adult to be adopted resides, setting forth the name, age, and residence of each petitioner and of the adult to be adopted, the name by which the adult is to be known, and his written consent to the adoption. The court may assign the petition for hearing at any time. After examining each petitioner and the adult sought to be adopted, the court, if satisfied that there is no reason why the adoption should not be granted, shall enter a decree of adoption and, if requested, shall change the name of the adopted adult. Thereafter, the relation between each petitioner and the adopted adult shall be, as to their legal rights and liabilities, the relation of parent and child.

    (b) Code Section 19-8-19, relating to the effect of a decree of adoption, and Code Section 19-8-20, relating to notice of adoption,  shall also apply to the adoption of adults.

    I forgot about the second part of your question.  You will still need to go through the formal citizenship procedures.  

    The law states:

    Adoptive children who were 18 years of age or older on

    February 27, 2001, do not qualify for citizenship under the CCA.  Unless they derived or acquired citizenship under previous laws, such persons have not automatically become U.S. citizens. If they wish to become U.S. citizens, they must apply for naturalization and meet the eligibility requirements for that process."
