I got married last month, to my boyfriend that i dated for 3 years. I'm in a delima right now. My stepfather who is an american citizen broought my mom, brother, and i over from germany 8 years ago. Im 18 years old at the moment turning 19 next month. he left my mom 3 years agof for a girl that is a year older than i. my mom is still legally married to him. He promised her that he will get my brother and i's green card. instead he just left my mom hanging as a single mom not bothering once to help her finish or come up with the money for our green card. My hubby is a us american citizen. Due to the wedding we are having a hard time coming up with the money (1,600) for my green card. i read that the military let legal immigrants enlist. I have an I-94 on my passport from 8 years ago. If i wanted to could i enlist? or would i have to have a green card? I also tried to enroll into college but couldnt since i donthave an ssn. So i was told from a family friend to apply for a student visa. I want to get my degree in vet tech. I graduated highschool in may wih a gpa of 4.167. So i guess my question pretty much is will i be elligible to apply for a student visa even if im married to an american citizen? another one is, we want to have children together but we want to wait till i at least finish school. Would it help the process of having a green card if we had our first child together? I know this sounds wrong but im just wondering. Ever since my stepfather has just left my mom it's been so hard to get my green card due to her being a single parent mom. I would hate to have to go back to germany when i went to school here in the states (5-12 grade) and grew up here. i woulg greatly appriciate everyones answers. the immigration officer that works at the immigration office where i live is just completly rude and also wont really give us an answere to our question.

Are you here legally now?  If you are not, then you are in deep ****!!!  IF you are, then you can go to the social security office and get a SSN.  They will give you one that is not eligible for working.  You can also go to your school and talk to a foreign student counselor.  As far as I know, SSN is not required for enrollment as long as you have documentation to show that you are legal in this country.  There are tons of foreign students in this country that are enrolled in schools now who do not have any SSN.  This will buy your time to stay here legally and longer while you are working on getting your green card after you marry your boyfriend.  Once you are married to your boyfriend, you need to apply for green card right away.  If you can prove to the INS that you have been dating for a long time and are legitimately getting married, then it should not be hard to apply.  They will ask for photos and other proofs of your relationship while dating.  Getting pregnant without any permanent commitment would be a bad choice, because the INS will not care if you are pregnant or not.  They will still need to follow the law.  Your child may become a citizen once born, but you will not.

You should Adjust your status through marriage to your US Citizen husband as soon as possible. As soon as you get Receipt Notice of I-485, you are status become Pending AOS status which is totally legal. Although that doesn't guarantee your school enrollment. Also you should seriously consider consulting with immigration attorney.

You cannot join the army unless you have green card.

i second for Go Home illegal.  I-94 is class as a Non-Immigrant Visas. (expired at that!!)

you must have a green card or be a U.S citizenship to join the U.S army forces....

If your visa expired after that you are not legal. Mom can say it all she wants but it does not make it so. You have to have a green card before the military will accept you.Since your Mom can contact immigration and chat with them, you might ask her to call them or go down with you. As it looks you pretty much will end up in Germany

You can be an international student. The problem is you have to pay at list 3 times more than legal residents. Some colleges are very particular about the docs.

Do not have a child until you have your citizenship. If your hubbie decided to divorce u, you will fall out of status and that means become ilegal.

If u are ilegal, you child could help u when they have 18 to 21 years old. Till there, laws can change significantly, besides that, u too young for that responsabiulity based on certantly. Hope it open your mind. Good luck!

You are considered an Illegal alien BUT you do not need to leave this country. You're husband should file a petition for you ASAP. You do not need to go home. Once a petition is filed for you you are cleared. You will receive a working permit and a Green Card in about a year.

BUT

You will have problems if:

a.) You where arrested for a felony

b.) You have been told to depart the US but you have failed to do so

c.) You have been charged with a DUI

d.) You are not really married to a US Citizen

e.) You have disregarded orders for you to show up to an Immigration Court

f.) You have never been denied for a petition.

g.) You where married to someone else before marrying the US Citizen

h.) The Department of Homeland Security sees enough evidencce that your current marriage is a "Faux/Fixed Marriage"

If you are clear from the ff. cases you should be OK. Go to a Lawyer and file for a petition ASAP. Do not wait.
