Appeals court now what happens?

hello, in appeals court about how long do you have to wait for an appeal date [probate] i was found in favor for but now the other party has appealed ,about how long do we wait for a court date ? do we have to bring back witnesses or do they just use the manuscripts ,evidence already provided? thank you

  1. You might try logging on to the appeal court's web site for the rules & deadlines.  After a notice of appeal is filed the appellant usually has a certain number of days to furnish a transcript & then a certain number of days after that to file its brief.  Then the appellee files a reply brief & then the appellant usually has the right to file a response to the reply brief.  Then the court may or may not set a case for oral argument & after that the court will take its time to render an opinion.  There will normally not be additional evidence.  OR the court may just dismiss the case for any of a hundred reasons; or the parties may settle; or the court may remand the case to the trial court for additional proceedsings or even additional testimony & then the whole process may start over.
