Auto Repo?

When will the bank repo your car? The situation is this;

got a divorce ex took car, ex has been late on every payment for the last year went few months with out payment and had insurance canceled on the car twice in the last year, recieved letters from bank stating that.....ex can not get the car refinanced since ex is still late on payments and has HORRIBLE credit.. have been late on car payment before divorce also..

My question is when will the bank decide theyve had enough and take the car?? They call me constantly for payment and i know legally i am responsible for the payment but i dont have the car and i feel ex should pay it or give the car back...

what elso can i do to get out of the contract?

It sounds like the loan is in your name, your ex has nothing to lose, oh he will lose the car eventually, but for now he is driving for free. Once the vehicle is repossessed your credit will be ruined. Go and see a lawyer, if you are the one on the loan note, the car should be in your possession.

your lawyer in the divorce should have taken care of this problem he should not have the car if you have the loan

call the finance company tell them you are not in possession of the car and as the person on the note, you want it picked up. then sue the deadbeat in small claims or civil court for the amount you will be responsible to pay for the car.
