I have an back injury ever since November of last year..I have a lawyer and everything...How much do you think I well get back on my settlement..???

  1. you really expect us to know what kind of settlement to expect with "back injury" being your description?   Dont you think your being slightly vague?  Every single person almost whos in a car accident has some sort of back injury- there are all different kinds.

    Why dont you ask your lawyer- afterall what else are you paying 1/3 of your settlement to them for?


  2. First, you have an attorney, why are you asking this question on YA?  

    Second, nobody can possibly answer this question with the information you posted.  What kind of back injury?  Over exaggerated/treated soft tissue injury?  Herniations with impingement?  Was surgery needed?  If so, what kind?  How long did you treat for, and what kind of treatment.  Did you miss any time from work?  What do you do for a living?  How has this injury effected your daily activities?  Do you live in a PIP state?  If so, have your medicals been paid?  

    See, you cannot just ask such a broad answer and expect a good answer.  

    I can tell you, your claim will be evaluated based on the nature and extent of your injury, disability, treatment and permanency, if any.  Your special damages(lost wages/medicals) will be included if they were not already paid.   If you have any comparative negligence, your percent of negligence will be deducted from the full value.  

    Potentially, the most you can recover is the policy limits of the other party.

  3. You have a lawyer.

    You will be paying your lawyer a very large chunk of any settlement you get. Easily 33% plus expenses.

    Therefore, ask him.

    Thats what you pay him for. Stop wasting our time.
