By Owner...Agent???

I was trying by owner and now want to list with an agent, but I do have two potential buyers. So if I list with an agent and one of those two come back and put an offer...how can I exclude them from the contract? Can i?

  2. Yes, you can exclude people from the listing.  Generally, the Realtor will only want to grant the exclusions for a period of time, in my area 30 - 45 days is typical.  But if you want to exclude them for the entire term of the contract, hopefully your Realtor will grant this.

Anything can be written into a contract, if the other party is willing to accept the terms.  You could ask to specify those two individuals and maybe pay the agent a reasonable flat fee if one of them buys it.  Keep in mind, that once the agent signs you on, they are working for you and may have expenses incurred, even though one of your buyers ends up taking it.

  4. You would cancel the contract with your agent and then sell the property on your own. Most agent contracts can be cancelled at any time. There could be some legal issues if the buyer has any kind of relationship with the realtor. It's best to pick one way or the other.
