Can you sue for an STD?

I need a lawyer opinion on whether or not you can sue someone for giving you an STD when they KNEW they had it and tell you that it's

"no big deal"????

  1. Can you prove the person knew (s)he had the STD? In the United States (which i'm presuming you hail from, since you're wanting to sue over something stupid), the defendant is innocent until proven guilty....

    which places the burden of proof upon YOU.


  2. Did he lie about having it when you asked, and you can prove that he knew he had it and could transmit it to you? If so then maybe you would have a civil case of some sort but I'm not sure? Maybe ask a lawyer- some will give free initial consultations and they could tell you if you have a case or not.

    If he didn't lie or you didn't really ask about it then you couldn't sue. In that type of situation you have a responsibility to protect yourself, it'd be equally your fault and his that you were infected.

    Overall though, this stuff happens. You should make your boyfriends wear condoms until you have PROOF that they don't have any STDs and are sure that they are being faithful.  

  3. Sorry about your situation.  People can be really mean on Y/A some times.

    I'm  thinking people sue for just about every thing else so probably.  Especially if this person had knowledge of being infected and didn’t tell you.


  4. No, the only way you can sue for something like that is when it's life threatening like HIV.  

  5. No, that's not actionable. By the way, what did you get? Herpes? HIV? Why don't you go on People's court or Judge Judy. I'd love to see that episode.

  6. Not that I know of. If he refused to take a test, that MAY be different.

  7. I would make a few phone calls. I would call this depraved indifference.
