Car Insurance Claim?

My girlfriend parked her car at home and lives on a hill, a neighbour who lives further up the hill forgot to put her handbrake on her car so it rolled down and hit my girlfriends and caused £1300 worth of damage. She not had time yet to put the car into garage for repair. 3 weeks later someone pulled out onto a main road and hit my girlfriends car and wrote it off. How can my girlfriend now claim the £1300 for the first accident if the car is now written off?

    The first thing you should do was to contact your insurance company.  Its his fault ! End of. Just speak to your insurance company.


  2. If she didnt' actually get it fixed, there is not much you can do.

    If she had spent the 1300 out of her pocket, then there is a chance the insurance company would allow the claim to go through if she had talked to them and they assured her she'd be paid back when the claim went through.

    All things said, if she's not out any money, it's not "too" bad of a thing to have happened.  At least she made it out ok and is in good shape.

  3. Your girlfriend should've been onto the insurance company as soon as the first accident happened.  If she didn't, it's too late now...

  4. I am fairly well experienced in insurance (over 20 years) This is a bit of a mess.

    It will all start with the engineer for the second insurer to offer a pre-accident value. If this is less than expected due to the pre-accident damage then the first insurer should cough up. I can, however, imagine the two companies fecking it all up between them if they start talking so it could go any way.

    The legal position is to prevent unjust enrichment to your girlfriend. She should not make a profit out of this.

  5. its to late you can not claim for a retrospect accident if she did not report it at the time

It really doesn't matter about the first claim if the car is being written off and no deductions were made for the previous damage.  Sounds as if you would like her to be paid twice for the same damage.  That is called insurance fraud.  if the situation is as I described above, I would leave well enough alone.
