Car accident?

I was in a car accident this year, that was my fault. I was in another lane, when i thought no one was in the lane to my left and when i tired to get over..i accidently hit the person on their passenger side. I didnt hit them full on, it was more so trying to move out the way going about maybe 20 or 30 and my car scraped the side of theirs (i drive an 87 volvo, they have a ford explorerish car) by putting a deep scratch and flattened their tire. At the scene the woman was nice, said she wasnt hurt told that to me, insurance people and the police guy. Basically few days later I'm being told im gonna get sued. Insurance people took pix of the car (mine) and i didnt hear from them since. Today i was told shes trying to sue, for hospital visits?

Im just wondering..is there anyway in which i wouldnt be sued? I know it was my fault, but if its where, no this couldnt have happened cos she hit you on this side, or the photos show this or that.

Anyway any responses would be good thanks

  1. You need to contact your insurance company and find out what is happening with the claim.  Just b/c the lady didn't have any injuries at the time of the accident doesn't mean she wasn't sore the next day.  Hopefully your insurance company will pay her enough to make her go away and not sue.

  3. This is why you have insurance.  Your company will take care of everything.  Your rates will go up, but they do any time  you have an accident.

  4. You say you sideswiped another car, going only about 20 to 30MPH. You scratched their car and flattened a tire. The woman driving said she wasn't hurt, but now she's suing you.

    Now you're asking, if there is anyway in which you wouldn't be sued. That is a kind of a broad question. Anybody can sue anybody else for any thing they feel like. Winning any money is another matter.

    After the incident, she just might decide that she could say she had a breakdown and sue you for lost wages and doctor expenses and pain and suffering.

    Or maybe she really had a nervous breakdown.

    She also may have been injured.

    Stuff like this is usually handled by the insurance companies, and you may not even have to go to court.

Sounds as if you were insured at the time of the accident so you need to notify your insurance company of the "Rumor" that you will be "sued".  If you are sued, your insurance will protect and represent you.  That is what insurance is for, you pay premiums for protection but they can't protect you if you don't notify them
