ok, i am going to be paying child support on my son, I am not working right now, but am going to be getting a job shortly. My questions are, if I'm NOT behind and go to file income tax will I get it or will it go to the child support?? Another one is as long as I am paying and Not behind can I continue to pay it on my own or will they just take it from my check every month??? I live in Texas

  1. Your taxes will not be "intercepted" if you are not behind. In order to have your tax return taken away for child support, there has to be a court order for "tax return intercept." Such a court order is not issued unless there is a delinquency in your support payments.

  2. If you are not delinquent with payments, your tax returns would not be garnished. The court usually decides if the payments are taken directly out of your check. You will need to sign up with the Child Support Bureau for paying.
