Could they be sued?

My friend told me that she did 8 hours or more of work -straight- at the cafe she works at, and was never told by her manager that you MUST have a break at 5 hours [lunch break, tea break etc], as its illegal in Australia.

Shes only 14 so I guess that she didn't know half of the work force rights....

Could she actually sue her place?

Everyone's looking for a quick buck, if she worked that long @ 14, she could have opened her mouth and said something. Lawyer fee would probably take everything she was awarded (if she won) and perhaps more. Her call.

I don't know for sure, but my guess would be that she could if this happened repeatedly.  Otherwise, maybe not, if someone claims that it is each individual's responsibility to know their rights and entitlements and then ask that they be granted on the job.

It's worth a try!She could claim PSD and retire at 14 with the settlement.P.S. I hope she buys you something nice.
