Court Heaing Lien on Home?

Hello, If credit card Co. is going to put a lien on my home, what goes on in the court hearing? Anything I should do to prepare?

I had to stop work to take care of my 92 year old mother 24/7. Do not have the money to pay the credit card co. Amount American Express 7000 dollars. Don't own anything else or have any money in the bank. She gets 1100 a month penton, which we use to pay bills for the home. I'm sure it is just a matter of time until they try to put a lien on the house. House value 48,000.

We only have one joint checking account..

  1. File Bankruptcy and save the house NOW!

    Do not wait!

Have you offered a payment plan to AmEx?  Even if it was $10 a month that would show the court you are trying to make good on the debt.  Unless there is some reason you do not feel you owe the money there is really not much to prepare.  A lien against the house will not effect you unless you intend to sell the house or get a loan against it.

  3. If you have assets, they will be attached.

  4. A credit card company cannot put a lien on the house.  They can file suit and take judgment against you but not against the house.  Only govt (IRS) and mortgage companies can do that.  You will have to negotiate with AmEx and start making some type of payment.

  5. If they get the judgement, you are looking at possible lien on your home (if in your name), bank account garnishment or wage garnishment--depending on the state you live in.  The lien on your home will not affect anything unless you try to sell your home.  Of course, it does affect your credit.  Contact the credit card company and advise them of what is going on.  They may be able to get you on a hardship program.  Good Luck!   ***        If a credit card company takes you to court, and gets a judgement--yes a lien can be placed on the home--if allowed in your state.   ***
