Does this consider trespassing?

does taking pictures of someones backyard BUT not going in, just maybe climbing on their wall to take the pictures, does that still consider as trespassing?

--i DONT need any "i dont know" answers. saying "what you need to do that for!?!?" does NOT help too. don't give any replies i will not need. it gets on peoples nerves

  1. Climbing on someone's fence can be trespassing.  


  2. Invasion of privacy, stalking, trespassing, are the first three things that come to mind. If you are using the pictures for a court case they could be inadmissible because they were procured by an other than legal means.

  3. Defeating a barrier (climbing THEIR wall) will probably be trespassing depending where the wall sits. Depending on your state/city, you might have also violated a privacy law or two. More than likely the court will throw the pictures out due to the nature they were taken in.

  4. No, that is not terspassing unless they are "defacing"  the wall by leaving their shoe prints on it :P

    I doubt this will hold up in court, as far as it would go is to the cops for defacing property.
